Please review: this is a template policy prepared for Europe26 DMC. It should be checked by your legal adviser, and the details in square brackets completed, before it is relied on.
1. About these terms
These terms apply to the use of this website and to bookings made with [company legal name], trading as Europe26 DMC (“we”, “us”), company number [number], registered office [registered address]. Please read them before you book. Your booking confirmation may contain additional terms for a particular tour or service; if it does, those terms apply as well, and take priority where they differ.
2. Enquiries and quotes
Sending an enquiry through this website does not create a booking. Prices shown on the website are “from” prices per person, are given for guidance and depend on dates, availability and the number of travellers. We will confirm the price, what it includes and the payment terms in a written quote. Quotes are valid for the period stated on them and are subject to availability at the time you accept.
3. Making a booking
A booking is made when you accept our quote and pay the deposit, or the full price if so stated, and we send you a written booking confirmation. The person who makes the booking confirms that they are at least 18 years old and has the authority of everyone named on the booking to accept these terms on their behalf.
4. Payment
The deposit and the date by which the balance must be paid are as stated in your booking confirmation. If the balance is not paid on time, we may treat the booking as cancelled by you, and the cancellation charges below will apply. Some services, such as certain flights, rail tickets, charters or event tickets, must be paid in full at the time of booking; we will tell you when this is the case.
5. Changes by you
If you wish to change your booking, tell us in writing as soon as possible. We will do our best to help, but changes depend on availability and the terms of our suppliers. Any additional cost, together with a reasonable administration charge as stated in your booking confirmation, is payable by you.
6. Cancellation by you
You may cancel your booking at any time by writing to us. Cancellation charges apply from the date we receive your notice, as set out in your booking confirmation, and generally increase as the travel date gets closer. Where a supplier’s own cancellation terms are stricter, for example for non-refundable flights or rail fares, we will make these clear before you book. Your travel insurance may cover cancellation charges in some circumstances.
7. Changes and cancellation by us
We plan carefully, but occasionally we may need to change or cancel arrangements. If we make a significant change before you travel, we will tell you as soon as we can and offer you the choice of accepting the change, taking an alternative of similar standard, or cancelling and receiving a full refund of the money you have paid us for the affected services. We will not cancel a booking after the balance is paid unless it is necessary because of circumstances outside our control, or because a minimum number of travellers stated in the booking has not been reached.
8. Circumstances outside our control
We are not responsible for changes, delays or failures caused by unusual and unforeseeable circumstances beyond our control, the consequences of which could not have been avoided even with all reasonable care. Examples include war, terrorism, civil unrest, natural disasters, extreme weather, epidemics, industrial action and the closure of airports, ports or borders.
9. Passports, visas and health
You are responsible for holding a valid passport, any visas or travel authorisations, and any vaccinations required for your trip, and for checking the entry rules of every country you visit. We can give general guidance, and for Umrah journeys we check the current visa requirements with you before confirming, but the final responsibility is yours. Up-to-date travel advice is published by the UK Foreign, Commonwealth and Development Office at gov.uk/foreign-travel-advice.
10. Travel insurance
We strongly recommend that everyone travelling takes out suitable travel insurance from the time of booking, covering cancellation, medical expenses, repatriation and personal belongings, and any activities you plan to do.
11. Your responsibilities during the trip
Please arrive on time for pick-ups and tours, follow the reasonable instructions of drivers, guides and suppliers, and respect local laws and customs. Drivers and guides may refuse to carry anyone whose behaviour puts others at risk. Missed services caused by late arrival are not refundable.
12. Our liability
We will provide the services in your booking with reasonable skill and care. Many services are provided by independent suppliers, and their own terms and conditions, as well as international conventions on air, rail and sea travel, may limit the compensation available. Except for death or personal injury caused by our negligence, or any liability that cannot be limited by law, our liability is limited to [the price of the affected services / an amount stated in your booking confirmation]. We are not liable for losses that were not foreseeable when the booking was made, or for business losses.
13. Complaints
If something is not right during your trip, please tell your guide, driver or our team straight away so that we can try to fix it while you are there. If you remain unhappy, write to us at [complaints email address] within 28 days of your return, with your booking reference. We will acknowledge your complaint and aim to reply in full within 28 days.
14. Use of this website
The content of this website is provided for general information. We try to keep it accurate, but tour details, inclusions and prices can change, and the details in your booking confirmation prevail. Images are for illustration. You may not copy or reuse content from this website for commercial purposes without our permission.
15. Governing law
These terms are governed by the law of [England and Wales / Scotland], and the courts of [England and Wales / Scotland] have jurisdiction. If you live in another part of the UK, you may also bring proceedings in your local courts.
